Grocery Chain Fined $72,500 by OSHA
The U.S. Occupational Health & Safety Administration (OSHA) fined a Massachusetts grocery chain over $70,000 for repeated failure to protect warehouse workers from forklift hazards.
DeMoulas, based in Tewksbury, MA, had ongoing problems at warehouse located at 875 East St. On August 11, OSHA began its inspection after a collision between a forklift and a powered jack that injured a worker. The fines totaled $72,500.
Some of OSHA’s findings included failure to provide required refresher training to forklift operators involved in accidents, not ensuring that operators slowed their vehicles and sounded their warning horns, failing to check braking systems and skipping routine inspections for safety.
OSHA cited DeMoulas for similar hazards nearly 13 years ago, in October 2001. Repeat citations increase regular OSHA fines considerably.
“Forklifts pose serious hazards to workers if they are not properly maintained and if their operators are not effectively trained,” said Richard Fazzio, OSHA’s area director for northeastern Massachusetts. “The sizable fines in this case reflect this employer’s repeated failure to maintain the required safeguards.”
DeMoulas has 15 business days from the citations to take one of 3 actions:
- Comply with citation recommendations
- Request and participate in an informal conference with the OSHA area director
- Contest citations before the independent Occupational Safety and Health Review Commission
